Terms and Conditions of Sale

Validity of Terms and Conditions of Sale:

  1. The Terms and Conditions of Sale shall be applicable between the Buyer (hereinafter Consumer) and the undertaking Sonne Shop OÜ (hereinafter Lineashop.ee) when purchasing goods and services from the Lineashop.ee webshop.
  2. In addition to these Terms and Conditions, the legal relationships arising from the purchasing of goods from the Lineashop.ee webshop are regulated by the Law of Obligations Act, the Consumer Protection Act, and other legislation valid in the Republic of Estonia.
  3. Lineashop.ee reserves the right to make changes to the Terms and Conditions of Sale. These changes will be listed on the Lineashop.ee web page

Price information

  1. All prices displayed in the Lineashop.ee webshop include VAT of 20%.
  2. In the case of purchases totalling less than EUR 50, the cost of transport based on the method selected by the Consumer will be added to the total due.
  3. Prices are valid from the formalisation of the order until the expiry of the payment term (48 hours after the formalisation of the order) for the formalised order.
  4. If the order has been submitted prior to the change in the Terms and Conditions of Sale or prices, the Terms and Conditions that were valid at the time of the formalisation of the order shall be applied to the legal relationships having arisen between the Consumer and Lineashop.ee.
  5. Lineashop.ee reserves the right to make changes to the Terms and Conditions of Sale. These changes will be listed on the Lineashop.ee web page

Formalisation of an order

  1. Add the desired goods to your shopping basket.
  2. To formalise your order, in the shopping basket click on the link Formalise Order.
  3. On the order formalisation page, complete the required data fields, select a suitable method of delivery for your products, pay, and click on the link Confirm Order. You will then be directed to your bank to pay the invoice. You can choose the payment method that suits you the best: Swedbank, SEB Pank, Luminor, Coop Pank, LHV Pank, Citadele Pank, Krediidipank with a bank link, credit card, invoice or Montonio installment. When paying via bank transfer, an invoice will be displayed on the screen, which you can pay as a euro payment in your bank of choice. Payments are made in euros (€). Data for performing a euro payment, along with all valid state taxes and additional fees, can be found in the invoice that is displayed on the screen once you have confirmed the order.
  4. Carefully complete the fields on the data and order confirmation page, since the fast and seamless delivery of your purchased products as well as the resolution of any later disputes and claims depends on the accuracy and veracity of the information submitted.
  5. Orders in the Lineashop.ee webshop will be handled on working days, Mon-Fri from 09.00–17.00.

Entry into force of the contract of sale

  1. With the contract of sale for the goods, Lineashop.ee undertakes to transfer to the Consumer existing goods, goods that are being prepared or that will be acquired in the future by Lineashop.ee, and to make possible the transfer of ownership to the Consumer. The Consumer, however, undertakes to pay Lineashop.ee the sum indicated on the presented invoice for the goods and to take receipt of the goods.
  2. Orders, for which payment has not been received, shall be cancelled 48 hours after the formalisation of the order.
  3. The contract of sale enters into force following the receipt of the payment made by the Consumer in the bank account of Lineashop.ee.
  4. If Lineashop.ee is unable to deliver the ordered goods due to the product expiration, being out of stock of or for any other reason, the buyer will be notified as soon as possible and the money paid (incl. delivery costs) will be refunded within 2 working days. Depending on the payment method, it may take up to 7 business days / a few days to receive.

Delivery

  1. Following the entry into force of the contract of sale, Lineashop.ee shall assemble the order and hand it over to the company’s logistics partners for delivery.
  2. The delivery times shown on the web page of the e-shop shall be applicable as of the moment of receipt of the order amount in the bank account of Lineashop.ee.
  3. To ensure delivery without delay, you must be careful when formalising the order and make sure that the delivery information you enter is correct and valid.
  4. Lineashop.ee shall not be liable for a delay in the delivery of the goods, if the goods have been handed over to our logistics partners in a timely manner, but the delay in delivery is caused by circumstances which Lineashop.ee could not have influenced or foreseen.
  5. The maximum delivery time for packages in Estonia is 5 working days, and up to 6 working days in other countries.
  6. The delivery price added to products depends on the selected method of delivery (see here). If you spend EUR 50 or more, shipping to parcel terminals in Estonia is free.
  7. Delivery is performed in by Omniva, Itella, and DPD.

Right of return

  1. The consumer’s right of return is prescribed by legislation and is not a feature unique to ordering from the Lineashop.ee webshop.
  2. Following the receipt of the order, the Consumer has the right to withdraw from a contract concluded in the e-shop, without disclosing the reason why, within 14 days. In accordance with subsection 53 (4) of the Law of Obligations Act, the Consumer has the right to withdraw in the case of such goods which are not suitable for return due to their nature. Among other things, cosmetic products and perfumes in open packaging are not subject to return.
  3. In the event of the deterioration of the condition of goods that are subject to return, the Consumer shall be responsible for the decrease in the value of the goods if the Consumer has used the goods in a manner other than what is necessary to establish the nature, characteristics and functioning of the goods. In order to establish the nature, characteristics and functioning of the goods, the Consumer should only handle and use the goods in the same manner as the consumer would customarily be allowed to do in a shop.

  4. In order to return the Goods, the Consumer must submit an application for withdrawing from the purchasing of the Goods to the e-mail address info@lineashop.ee, at the latest within 14 days after receipt of the goods.

  5. The Consumer must return the Goods within a period of 14 days after submitting the application or submit documentation proving that the Goods were transferred to a logistics company during the above mentioned period of time.
  6. The Consumer does not have to return the Goods via the mediation of the logistics company, if Lineashop.ee has consented to the goods being collected in person.
  7. Upon receipt of an application for withdrawal, Lineashop.ee shall return to the consumer immediately, but at the latest after 14 days, all of the payments received from the Consumer on the basis of the contract, including the costs of delivery of the goods used by the Consumer, except if the consumer has expressly opted for a type of delivery other than the least expensive type of standard delivery offered by Lineashop.ee, then Lineashop.ees hall not be required to reimburse the Consumer for the costs which exceed the costs relating to the standard type of delivery.

Force majeure

  1. Lineashop.ee shall not be held liable for damages caused to the Consumer or for a delay in the delivery of the goods if the damage or delay in delivery of the goods is a result of circumstances which Lineashop.ee could not influence or foresee.

Protection and processing of personal data

  1. The client’s personal data is processed in accordance with the Personal Data Protection Act.
  2. Lineashop.ee collects the Consumer’s personal information when creating the customer’s account and/or formalising an order.
  3. Processed personal data includes the Consumer’s name, e-mail address, mobile telephone number, and consumption preferences.
  4. Lineashop.ee uses personal data to provide services to the Consumer, for further development, and personalisation. Under the specified services, the sale of goods to Consumers through the Lineashop.ee web page and the organising of personalised offers should be kept in mind.
  5. By entering their data in the web shop and providing the corresponding confirmation, the Consumer grants the right to collect and process the Consumer’s personal data and to forward it to logistics partners for the delivery of the goods.
  6. Lineashop.ee has the right to use the Consumer’s permanent address to send the Consumer advertisements and other information.
  7. The Consumer has the right at any time to prohibit the collection and use of personal data, except if it is necessary to recover a claim arising from the contract or deliver the goods. Consent to using the above mentioned personal data cannot be rescinded retroactively.
  8. Using electronic personal data for the purposes of direct mail takes place only if the Consumer has granted permission to do so on the Lineashop.ee web page.
  9. Encrypted data communication with banks when paying for purchases ensures the security of the Consumer’s personal banking identifiers, to which the web shop does not have access.
  10. Lineashop.ee does not forward personal data collected on the Customer to third parties.

Procedure for submitting a claim

  1. Lineashop.ee shall be liable for any defects in or the non-conformity of goods sold to the Consumer, which appear within two years as of the transferring of the goods to the Consumer.
  2. Upon the appearance of a defect the Consumer has the right, at the latest within two months, to contact Lineashop.ee, submitting the invoice on the basis of which the goods were paid for.
  3. Upon the appearance of defects in the goods, we ask that you please stop using the goods.
  4. The repair or replacement of defective goods shall be agreed upon by Lineashop.ee and the Consumer. Repair costs shall be covered by Lineashop.ee.
  5. Lineashop.ee is not liable for any defects in the goods resulting from the improper storage or use of the product by the Consumer.
  6. In the event of the non-conformity of the goods or the appearance of defects, we ask that you send a complaint to the e-mail address info@lineashop.ee. The complaint should include the name of the person who submitted the order, their contact telephone, order number and a specific description of the non-conformity of the goods to the Terms and Conditions.
  7. The claim regarding the non-conformity of the goods or the discovery of defects must be submitted within two months as of the discovery of the non-conformity or defect.
  8. All claims shall be reviewed and the Consumer contacted at the first opportunity, but no later than 14 days after the receipt of the claim.
  9. The Consumer has the right to demand a reduction in the purchase price from Lineashop.ee or termination of the contract and a refund of the sum paid for the goods if Lineashop.ee is unable to repair or replace the goods or the repair or replacement of goods fails, the Lineashop.ee web shop has failed to remedy the defect within a reasonable period of time, and if the Consumer has been subject to unreasonable inconveniences.

Right of the Buyer to contact the Consumer Protection Board’s Consumer Disputes Committee

  1. If Lineashop.ee has refused to resolve the Consumer’s complaint or the Consumer disagrees with the solution offered by Lineashop.ee and finds that his or her rights have been violated or interests damaged, the Consumer may submit a complaint to the Consumer Disputes Committee, via the Consumer Protection Board, or to a court. The Consumer may submit a complaint personally or via a representative. Information on the Consumer Disputes Committee is available on the Estonian Consumer Protection Board (Tarbijakaitseamet) webpage. To resolve problems arising in Member States of the European Union, please contact the European Consumer Centre of Estonia.
